Biography: Thomas M. Freeman

EDUCATION Tom attended the University of California at Berkeley where he majored in English and Economics and graduated with distinction in 1977. He received his legal education at the University of California, Hastings College of the Law in San Francisco, where he graduated in 1983. While at Hastings Tom was a member of the Constitutional Law Quarterly law journal and externed for the Hon. Eugene F. Lynch of the United States District Court for the Northern District of California in San Francisco and also for the Division of Judges of the National Labor Relations Board.

PROFESSIONAL BACKGROUND After law school Tom clerked for the Hon. Robert E. Coyle of the United States District Court for the Eastern District of California in Fresno. Following his clerkship Tom joined the Oakland firm of Crosby, Heafey, Roach & May, which later merged with Reed Smith. While at Crosby Heafey and Reed Smith Tom’s practice focused on civil litigation with an emphasis in medical device and pharmaceutical product liability, insurance coverage and bad-faith, business litigation and e-discovery and record management counseling. Tom has considerable experience in complex, multi-party civil litigation, including court and jury trials and various types of alternative dispute resolution proceedings in both state and federal courts.

COMMUNITY SERVICES Tom has participated extensively in pro bono work through the Alameda Bar Association’s Volunteer Legal Services Corporation. While at Reed Smith he helped establish a partnership between the firm and Hoover Elementary School in Oakland. Tom has continued this work at Hoover through the Oakland Rotary Club where he is also active in various civic activities

PROFESSIONAL MEMBERSHIP In addition to membership in the California State Bar and Alameda County Bar Association, Tom is also admitted to practice before the United States District Court for the Eastern, Central, Northern and Southern Districts. He is also a long-standing member of the Torts and Insurance Practice Section of the American Bar Association, the Litigation section of the California State Bar and the Alameda County Bar Association. Tom has also participated in the Sedona Conference Working Group on Litigation Holds and the Defense Research Institute.

PUBLICATIONS & PRESENTATIONS Tom has made numerous presentations on issues related to effective record retention and management and e-discovery issues. He has also published on the issues of selection of e-discovery partners and email management and best practices in litigation holds, including "Legal Considerations with Respect to Litigation Hold Policy," Records Retention – Critical Considerations Surrounding Records Management published September 2005 by the Association of Corporate Counsel.
